Welcome to the first instalment of CelticTaxCase.  As the thousands who are following on Twitter know our first blog was due for Sunday but such is the unprecedented demand for answers we thought it only fair to do an introductory FAQ blog to outline our intentions and dispel any myths that are doing the rounds on Twitter:

 

Q. Why are you setting up this blog?

A. Over the last couple of years the Internet and social media has been full of Rangers hating ‘journalists’ slandering The Club and dragging us to the cliff edge.  With The Club now recovering from their sustained attacks and looking to come out of Administration stronger than ever we feel it’s time that other clubs, specifically Celtics, finances be properly examined.

 

Q. Are HMRC currently investigating Celtic?

A. At the moment the short answer is no.  Having said that though the short answer is very misleading.  HMRC have declared war on football clubs as Portsmouth, Hearts and Rangers have found out in recent months.  There has been also some less well reported exchanges between HRMC and football clubs over the use of image rights which I personally think has certain people at Celtic Park very worried.

 

Q. What’s the deal with image rights?

A. Image rights are not illegal and are not tax avoidance if they can be justified and are used properly.  Maybe Celtic have used them properly and adequately valued the image rights of players such as Nakamura, however, if you look at merchandising and sponsorship figures in Celtic PLC’s accounts through the years I personally don’t think the image rights are worth as much as what they were perhaps specified as in contracts.

 

Q. If what you think is true what are the implications?

A.  Lets use for example Player Y earning £40,000 a week at Club X for four years.  £20,000 is wages and all tax and national insurance is paid properly and £20,000 is for image rights.  Player Y earns £4m in total from image rights through the duration of his contract yet only pays 28% rate of tax when in reality he should be paying 50% tax.  This leaves a tax shortfall of nearly £900,000.  If you multiply that by maybe 5 or 6 players doing something similar and add interest and penalties you are looking at potential liabilities of upwards of £15 million.

 

Q. Are Celtic guilty of this?  When is the bill likely to land at Celtic Park?

A.  In all honesty at the moment we don’t know but the chances are they are maybe guilty.

 

Q. Without evidence how can you speculate they are maybe guilty?

A.  I’ve done extensive research into those in power at Celtic Park and believe that Dermot Desmond is the man who pulls the strings over there.  It is my personal belief that the rest of them are merely front men.  We would suggest that people read up on the Moriarty Tribunal where it was found that Mr Desmond made payments to the Irish Taoiseach Charles Haughey to the value of at least £125,000 via a Swiss bank account which were never declared by Mr Haughey.  Although no wrong doing was ever proven against Mr Desmond it does raise serious questions.  Especially as this was not an isolated incident.

 

Q. Good work.  This sounds like potentially a ‘smoking gun’.  What else can you tell us?

A.  I personally believe there was something fishy about the deals that saw Roy and Robbie Keane play for Celtic.  Some have speculated that Celtic received ‘soft loans’ for these deals from the aforementioned Dermot Desmond.  I’m currently investigating ‘soft loans’, whether they are illegal under any article of SPL/SFA regulations and whether they were used at Celtic Park.  Could be interesting.

 

Q. What about stories of fabricated attendances at Celtic Park?

A.  This is something that will be difficult to prove however it’s something I will look into.  The fact is that back in the 1960’s the oldCeltic Park regularly hosted crowds of 75,000 people at Old Firm games and European games.  In the 1980’s and early 90’s the stadium was every bit as busy looking at TV pictures for Old Firm matches but crowds are listed as 52,000.  Lets speculate that over a period of 10 years Celtic played an average of 22 home matches a season and rounded down their crowds by 10,000 a match.  If the average admission price through those years was £8 we are looking at liabilities of £8 x 20% VAT x 22 matches x 10 seasons x 10,000 fans = £35,200,000!  This would be before interest and penalties and could make the Rangers ‘Big Tax Case’ seem almost not worth talking about.

 

Q.  Is it true Celtic have used EBT’s?

A.  It is widely recognised that they did use EBT’s with Juninho.  I don’t know much detail about this but if they were used incorrectly and if they were accompanied by a “second contract” then every game he played for Celtic could potentially be deemed 3-0 to the opposition which could result in demotion to the first division and the annulment of Celtics 2005 Scottish Cup victory… Martin O’Neill’s last trophy at the club!!!!

 

Q.  So what’s next?

A.  A lot more digging to be done but we will be back at some point next week to put some flesh on the bones we’ve outlined above.  Anyone who can provide us with any evidence to support what we think might have happened at Celtic Park please contact me on twitter @celtictaxcase

    Let’s get this straight. Rangers are in massive financial difficulty. The club is in very real danger of going out of business as a result of gross mismanagement over a 20 year period and it’s the journalists and bloggers who broke the story who are your enemy???
    Now, rather than try to find out who is to blame for taking your club to it’s knees, you’d rather set up a blog trying to dig up dirt on Celtic??

    I shall watch with interest for what you manage to uncover. Just a wee hint though – RTC had ACTUAL evidence rather than just a hunch when he started his blog. I’m sure though he will be chuffed that you are such an admirer of his work that you have decided to try and copy him. The choice of name for your blog shows some marvellous original thinking on your part too.

    Anyway, I’m sure you’re busy so I’ll leave you to it.

    Unfortunately you will not get back the hours and days of your life that you have wasted on this. Can I suggest you spend around £200 and get a 3 or 4 hour consultation with any competent tax professional in Glasgow. Ideally with an interest in Celtic and/or Rangers. This will save you an awful lot more than that in freeing your time for positive ends.

    I honestly wish you well in anything constructive you do with the rest of your life.

    It is great to see a bit of balance on the web. We’ve been taking a doing for too long now when it is perfectly clear that we’re not the only ones who are using tax payers money.
    I would suggest that you carefully monitor the site though, because if it degenerates into a slagging show and pure vile get’s posted, it will only become a laughing stock. We might be in deep trouble but at least we can show that we are above sinking to their level.

    Perhaps your extensive research didn’t reveal he played 14 games, and losing 42 points would see Celtic placed 6th in the final 2004-05 SPL table.

    I can see where you are coming from giving examples of players and attendances and such, I know it is only examples, but at the time of the attendance thing it would not have been 20% vat. It would still be big numbers but it would be more credible if you were less general, you are obviously on to something here.
    The Desmond thing only dirties the water I think, it wouldn’t mean a lot as far as Celtic are concerned. I think everybody knows that he calls the shots in there, so that is not a great revelation.

    It is truly astonishing that Rangers are being taken to task by HMRC when everybody knows that Celtic are just as bad.

    They have maybe been a little more clever in hiding what they’ve done, but there is no doubt that whatever it is they are hiding will come out eventually, and even if the thing they’ve done is not as bad as first thought, it will surely be enough to have the club suspended prior to relegation to the third division, so there might be Old Firm games next season after all.

    Your maths seem to be miles off, the VAT rate was 17.5% not 20% (as of 4th january 2011). Also take Naka for example when he was playing for Celtic, Tax on Image rights was 24% and not 28% as you say! your investigating skills have a lot to be desired. In your opening note you say ” dispel any myths “. This seems to be a strange way to word. The facts about rangers are out for everyone to see. They are not myths. What you are writing is mythology with bucket loads of Disambiguation. This is nothing more than Anti Propoganda, to dilute rangers problem.

    Seems more like turning every issue that has been raised against Rangers in the last year is trying to turn upon Celtic. Although it has been widely reported that Celtic have no case to answer for any of the above claims – according to SFA, SPL, HMRC
    HMRC has already settled ALL ‘image rights’ tax cases they had with ALL UK clubs that were using that tax avoidance scheme for players that obviously had no image to have a right against. This was done within the last 3 weeks – according to HMRC tax expert who was on the BBC Radio 2 Jeremy Vibe show the day all the clubs settled – and FYI it only concerned clubs in England, NONE in Scotland were guilty of this, yup think everyone was surprised Rangers were innocent on this as well ha ha
    From your comments about attendances in the 1980’s I am guessing you are not of an age when you can remember those days. Stadiums changed after the Ibrox disaster and attendances were restricted by health & safety. Roof’s were put on many stadiums. Also you should remember that in the 1980’s both Rangers & Celtic were going through a particular lean spell in terms of winning trophies, and as you probably know many supporters only really appear when teams are winning (look at Rangers before Murray took over, with attendances of circa 8000-1000).

    Re Juninho’s EBT if true (which it is not and again do proper reaearch) then CFC would lose out of 1 Trophy.

    On the other hand RFC would lose out on 13 years of trophies ( Not to mention prize money) RFC would owe other clubs (PORTO being the first to lodge such a claim)

    You have made the classic mistake here, to be similar to other blogs that are trying to prove facts and to give some credence to what you are trying to say it is important to verify your theories.
    Other bloggers prefix their theories with ‘ many people say’, this was taken from another blog which makes things seem worse than they really are.

    If you take your first question and change it around it becomes, many people say HMRC are investigating Celtic. I know this is not currently true, but it is what the bloggers say, even though it could be factual, what these people have been doing over the last few years is start rumours and are currently claiming victory.     As the fortieth anniversary of Rangers’ greatest achievement on the field draws near, now is as good a time as any to remember that glorious occasion. Much has been written about Rangers triumph in May 24th, 1972 and it will always remained etched in my memory as to quote a terrible cliché, I was there!
    My brother Crichton, my future brother-in-law George and me made up the intrepid threesome bound for the distant Mediterranean port. Our means of transportation was an ancient Humber camper van which served as our sleeping quarters during the week long Odyssey. Since neither Crichton nor I had a driving licence, George was left with the Herculean task of conveying us single-handedly from the wilds of West Fife to Barcelona and back!

    We somehow made it over the Pyrenees with the Humber creaking ominously as it climbed the huge mountains which separate France from Spain. It was clear that from the moment we entered Spain that it was very different. We were ordered out of the van at customs control by uniformed men in strangely shaped, black patent hats. This was our first encounter with the notorious Guardia Civil, General Franco’s paramilitary force notorious for their brutal methods of suppressing any form of dissent.

    Much has been written about “Barcelona 1972”, much of it true some of it fantasy. What is clear is that to gain any understanding of the events, one has to understand the Spain of 1972. Francisco Franco took power illegally in Spain, following the end of the Spanish Civil War in 1939. Along with his buddies Hitler and Mussolini, he ruled ruthlessly and was particularly brutal in those regions which he saw as dangerous and disloyal. Barcelona being the capital of Catalonia was essentially a city under constant oppression.
    People were not allowed to associate in groups of more than three people, trade unions were banned, speaking Catalan was banned in schools and in public, there were no free elections.

    It was into this strange, alien world that Crichton, George and I wandered, truly innocents abroad. On the day of the game the number of Rangers supporters suddenly became much more visible. They gathered in the Plaça de Cataluyna and began the songs which were regarded with curiosity by the locals. The Guardia Civil stood back nervous at seeing so many people express themselves freely.
    Gradually the locals’ curiosity overcame their natural caution to observe these strange tall, fair skinned Aryans from the north. Divided by language, religion and culture, two diverse peoples engaged initially at least in nervous social intercourse.

    As I recall it was a clear morning with just a few clouds in the sky, perhaps a portend of the eventful day which was about to unfold.
    By two o’clock as a result of the chartered planes arriving, the Plaça de Catalunya had suddenly filled to overflowing. In those days, one of Her Brittanic Majesty’s notes would get you 320 pesetas. That is a lot of vino tinto and cerveza! At just forty pesetas for a carafe, the day was set and it was fiesta time. I remember clearly attempting to have a conversation in broken English with a diminutive Spaniard who reeked of garlic.
    ‘Señor, eet ees a pleashure to ‘ave you weet uz, thank you, thank you” he muttered with tears in his eyes.’

    After two litres of red wine, the wee man knew “Derry’s Walls” and “The Sash’ by heart. By this time, the huge square could no longer contain the thronging mass of humanity. New friendships had been established between one oppressed people and another with a long and dignified history which cherished individual rights and freedoms.They may have struggled to understand the impenetrable dialects of Larkhall, Harthill and Skye, but instinctively the locals knew the good guys had come to town.

    From the Plaça de Catalyna the great human cavalcade headed down the Ramblas, the main thoroughfare of Barcelona. From the high balconies above, dark eyed beauties tossed carnations, more wine was offered and gratefully accepted. Then almost imperceptibly at first, a faint chant could be discerned, growing each second in volume until it reached an incredible cacophony. ‘¡Libertad!¡Libertad!¡Libertad!

    The people had found their voice, Rangers being the main orifice for Catalan pride. All the while Franco’s acolytes watched on nervously, their itchy hands stroking their huge truncheons. We sensed what was coming but we were young, we were free and above all we were Rangers. At the end of the Ramblas, we turned left under the stunning “Arco de los Borrachos” and onto our date with destiny at the Nou Camp. The game still has a surreal quality to it, almost dreamlike.
    Any aspiring screen writer could not have come up with a better script. The venue of the game held in the last bastion of fascism with its unhealthy link to the Catholic church and its religious fanatics.
    Ranger’s opponents? The Godless, soulless artifact that was the Soviet Union. A society in which human beings were reduced to the status of ‘social units”. And between these two evils stood Rangers, standing for the true values of Christianity and decency.

    I have read a lot about Spain and its recent history and have retraced my steps three times. It was slightly scary to learn that the same route we ploughed that May day was in the footsteps of George Orwell and the International Brigade. Orwell and co may have come to Spain with different objectives and most probably had no interest in football. However, had George and his fellow democrats been present that balmy May night, you can be sure that he would have been cheering on the lads in blue and white. After all, the victory in Barcelona was more than just a game of football. Rangers has always been a lot more than football, the nation’s conscience and its heart and soul. Mr Taxman do you really want to erase such memories? I leave it up to you.
